1. Acceptance of These Terms
By creating an account or using the SwimLytic application ("App") or the swimlytic.com website ("Site"), you agree to these Terms of Use ("Terms") and to our Privacy Policy, which is an integral part of these Terms. If you do not agree, do not use the App.
SwimLytic is developed and operated by H2N Ventures LLC, a limited liability company registered in the State of Florida, United States.
2. Eligibility
- You must be at least 13 years old to use SwimLytic.
- Users aged 13 to 15 require the consent of at least one parent or legal guardian, collected in-App during sign-up (including the guardian's email address). The guardian may revoke this consent at any time via henrique@swimlytic.com, which results in closure of the account.
- Users aged 16 to 17 should use the App under the supervision of a parent or legal guardian.
- By creating an account, you declare that the information you provide is true and that you meet these age requirements.
3. Description of the Service
SwimLytic is an AI-powered swimming technique analysis application that:
- Lets you record or import short videos of your swimming;
- Analyzes the video entirely on your device, using computer vision to detect body landmarks. The video never leaves your phone, is never uploaded, and no frame of it is ever captured or retained by SwimLytic;
- Calculates the scores of 8 technique metrics (entry, catch, pull, recovery, rotation, kick, head position, and breathing);
- Assigns an overall score and tier for the stroke style you select;
- Provides reports with strengths, corrections, and recommended drills;
- Stores only the analysis results (the 8 metric scores, stroke style, tier, and report text) in your account. Never video, never images.
4. Beta Phase
SwimLytic is currently in a beta phase. This means:
- The service is provided "as is" and "as available", without warranties of any kind, express or implied;
- Features may be added, changed, or removed at any time, and analysis algorithms may be recalibrated (which can change scores between versions);
- We may suspend or discontinue the service, in whole or in part, at any time, with reasonable prior notice through the App when feasible;
- Occasional errors, inaccuracies, and downtime are expected during beta. We appreciate reports at henrique@swimlytic.com.
5. Account and Your Responsibilities
- Sign-in is passwordless: email magic link / one-time code, Sign in with Google, or Sign in with Apple. No password exists for your account.
- You are responsible for maintaining control of your email inbox and your Google/Apple account, since they grant access to your SwimLytic account.
- Each account is personal and non-transferable.
- You must provide truthful information and keep it up to date.
- You are responsible for all activity carried out through your account.
6. Service Communications
- Because sign-in is passwordless, we send transactional emails that are necessary to operate the service: sign-in links and one-time codes, and important notices about your account or changes to these Terms or the Privacy Policy.
- These operational messages are part of the service and are sent to every account holder.
- We do not send marketing emails without a separate, optional consent, and any such email will always include an unsubscribe option.
7. Subscriptions and Payments (Future Paid Plans)
The App is currently free during beta. When paid subscriptions launch:
- Payments will be processed exclusively by the Apple App Store or Google Play, according to your platform, with subscription management by RevenueCat. SwimLytic never receives or stores card data or any payment credentials.
- Subscriptions renew automatically at the end of each billing period unless canceled.
- Cancellation is done in the store's own settings (App Store or Google Play), not inside the App. Canceling stops the next renewal; it does not retroactively refund the current period.
- Refunds follow the policy of the store where the purchase was made (Apple or Google). Refund requests must be directed to the respective store.
- Prices may change; changes apply only from the next billing cycle, with prior notice.
- Deleting your account does not automatically cancel a store subscription. Cancel it in the store as well.
8. App Store Terms
- The App is distributed through the Apple App Store and Google Play. Your use of the App must also comply with the applicable store's terms of service.
- Apple Inc. and Google LLC are not parties to these Terms, have no obligation to provide support or maintenance for the App, and are not responsible for the App or its content.
- Where required by the stores' rules, Apple and Google (and their subsidiaries) are third-party beneficiaries of these Terms and may enforce them against you with respect to your use of the App.
9. Your Content (Videos)
- The videos you record or import remain yours: your property, on your device, under your exclusive control.
- SwimLytic processes each video locally, on your device only, for the sole purpose of generating the analysis you requested. Because processing is on-device, we never receive, host, copy, or retain your videos or any frame of them. There is nothing to license to us beyond that local processing.
- After the analysis, your video remains exactly where it was (your camera roll or device storage), untouched by us.
- You are responsible for the videos you analyze: you declare you have the right to use them, including consent from any other identifiable person appearing in them.
- Reports and score cards generated for you are for your personal use; you may share them socially, with credit to SwimLytic appreciated.
10. Privacy and Your Data
- How we handle personal data is described in detail in the Privacy Policy, which forms part of these Terms.
- The essentials, restated here because they define the product: analysis runs 100% on your device; your video is never uploaded, no frame is ever captured, and no video content is ever retained by SwimLytic, by architecture, not policy. Only the analysis results (the 8 metric scores, stroke style, tier, and report text) are stored in your account.
- Account data and analysis results are stored with our backend provider (Supabase), encrypted in transit (HTTPS/TLS).
- You can delete your account directly in the App at any time, and request a data export at henrique@swimlytic.com.
11. Acceptable Use
You agree NOT to:
- Use the App or Site for unlawful purposes;
- Attempt to reverse engineer, decompile, extract models from, or modify the App;
- Attempt to access other users' data or probe, scan, or test the vulnerability of our systems;
- Use bots, scripts, scraping, or automated tools to access the service;
- Circumvent plan limits, technical restrictions, or age/consent requirements;
- Analyze videos containing unlawful content or content you have no right to use;
- Resell, rent, or commercially exploit the service without prior written authorization;
- Interfere with the operation or security of the service.
Violation of this section may result in suspension or termination of your account.
12. Intellectual Property
- The App, the Site, the SwimLytic brand and logo, the analysis algorithms, the scoring system, the design, and all related content are the exclusive property of H2N Ventures LLC.
- These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
- Nothing in these Terms transfers any intellectual property right to you.
- Your videos are yours (Section 9); the analysis technology is ours.
13. Sports and Health Disclaimer: Read Carefully
- SwimLytic provides informational technique analysis generated by artificial intelligence. Scores, reports, and drill suggestions are estimates based on computer vision and are for informational and educational purposes only.
- SwimLytic is NOT medical advice, is not a medical device, and does not diagnose, treat, or prevent any condition.
- SwimLytic does not replace a qualified coach, professional supervision, or medical evaluation.
- Consult a physician or qualified health professional before beginning intense training or making significant changes to your training load.
- Always swim in safe conditions and under appropriate supervision. If you feel pain, discomfort, or suspect injury, stop and seek a health professional.
- Analysis accuracy varies with video quality, lighting, camera angle, and pool environment. Treat results as guidance, not ground truth.
14. Limitation of Liability
- To the maximum extent permitted by applicable law, H2N Ventures LLC shall not be liable for indirect, incidental, special, or consequential damages arising from use of the App, including training decisions made based on the analyses, injuries related to swimming practice, or loss of locally stored data.
- The service is provided "as is"; we do not guarantee uninterrupted availability, absence of errors, or that scores will be accurate for every video.
- In no event shall the total aggregate liability of H2N Ventures LLC exceed the amount you paid for the service in the 12 months preceding the event giving rise to the claim (or USD 50 if you paid nothing).
- Nothing in these Terms excludes or limits rights that applicable consumer law grants you and that cannot be waived by contract, including, for consumers in Brazil, the rights guaranteed by the Consumer Defense Code (CDC).
15. Termination
- You may close your account at any time directly in the App (account deletion is built in) or by emailing henrique@swimlytic.com. Deletion removes your account data as described in the Privacy Policy.
- We may suspend or terminate accounts that violate these Terms, with notice when feasible.
- Sections that by their nature survive termination (intellectual property, disclaimers, limitation of liability, governing law) remain in effect.
16. Changes to These Terms
- We may update these Terms periodically. Significant changes will be communicated through the App and/or the Site before taking effect.
- Continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree, stop using the App and delete your account.
17. Governing Law and Jurisdiction
- For users worldwide, these Terms are governed by the laws of the State of Florida, United States, and disputes shall be resolved in the courts located in Florida, USA, except where mandatory local law provides otherwise.
- For consumers in Brazil: Brazilian consumer protection law (CDC) and the LGPD remain fully applicable, and you may bring claims in the courts of your own domicile in Brazil, as guaranteed by Brazilian law.
18. Final Provisions
- Entire agreement: these Terms and the Privacy Policy constitute the entire agreement between you and H2N Ventures LLC regarding the service.
- Severability: if any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
- No waiver: failure to enforce any provision does not constitute a waiver of it.
- Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets, with notice to you.
