By creating an account or using SwimLytic, you agree to these Terms of Use. If you do not agree, do not use the app.

1. The Service

SwimLytic is an AI-powered swimming technique analysis app. From videos of your swim, it generates technical scores (0–100), tier classifications, reports and drill suggestions.

2. Nature of the Analyses — Important Notice

Scores and reports are AI-generated estimates based on computer vision. They are informational and educational.
SwimLytic is not a substitute for a qualified coach, medical evaluation or professional supervision.
Always swim in safe conditions; if you feel pain or injury, seek a health professional.
Accuracy may vary with video quality, lighting, angle and environment.

3. Account and Eligibility

You must provide truthful information when signing up.
Users under 16 need consent from a parent or legal guardian, requested at sign-up (LGPD Art. 14).
You are responsible for keeping your access secure.

4. Subscriptions and Payments

The app offers a free plan and paid subscriptions with additional features.
Payments are processed by the Apple App Store or Google Play. We never store card details.
Subscriptions renew automatically until cancelled in your store settings (App Store/Google Play).
Cancellations and refunds follow the store's policies.
Prices may change; changes apply to the next billing cycle with prior notice.

5. User Content

Videos you record/import remain yours. You grant us a limited license to process them exclusively to provide the service (analysis, card and report generation).
Generated cards may display your name, score and tier in public rankings and when shared by you.
You represent that you have the rights to the videos you submit (e.g., consent from other people appearing in them).

6. Acceptable Use

You may not: use the app for unlawful purposes; attempt to bypass plan limits; reverse-engineer, scrape or access the service in unauthorized automated ways; submit offensive content or third-party content without permission; interfere with the security or operation of the service.

7. Intellectual Property

The app, the SwimLytic brand, AI models, scoring algorithms, design and content are the property of H2N Ventures LLC. These terms do not transfer any intellectual property rights to you.

8. Privacy

Processing of personal data, including biometric data, is governed by our Privacy Policy, which is part of these Terms.

9. Service Availability and Changes

The service is provided "as is". We may change, suspend or discontinue features at any time, aiming to give reasonable notice of relevant changes. We do not guarantee uninterrupted availability.

10. Limitation of Liability

To the maximum extent permitted by law, H2N Ventures LLC is not liable for indirect, incidental or consequential damages arising from use of the app, including training decisions made based on the analyses. Nothing in these terms excludes rights guaranteed to you as a consumer under applicable law.

11. Termination

You may close your account at any time under Settings > Privacy. We may suspend or terminate accounts that violate these terms.

12. Governing Law

These terms are governed by the laws of the State of Florida, USA. For consumers in Brazil, rights under applicable Brazilian law (including CDC and LGPD) remain guaranteed.

13. Changes to These Terms

We may update these terms periodically. Relevant changes will be announced in the app and take effect upon publication.
